Terms of Service

By creating an account or using OutDare, you agree to these terms.

Read this carefully. Paragliding is a high-risk activity. The information OutDare provides — spot data, weather forecasts, and flyability verdicts — is for general guidance only. Every decision to fly is yours alone. OutDare is not a substitute for proper training, certified weather sources, official site rules, or your own judgment.

1. The service

OutDare is a mobile application that helps paraglider pilots discover flying sites, view weather forecasts, and receive notifications when conditions match their saved parameters. It also provides social features (friends, activity feed) and lets users contribute spot information to a shared community database.

2. Eligibility

You must be at least 16 years old to use OutDare (or 13 with verifiable parental consent in jurisdictions that permit it). By creating an account you represent that you meet this requirement. You are responsible for keeping your sign-in credentials secure; activity on your account is treated as your activity.

3. Acceptable use

You agree not to:

  • Submit spot information you know to be false, misleading, or that violates landowner restrictions.
  • Use the app to harass, threaten, or impersonate others.
  • Attempt to break, scrape, reverse-engineer, or overload our infrastructure.
  • Use OutDare for any commercial purpose without our written agreement.
  • Upload content you don't own or have the right to share.

We may suspend or terminate accounts that violate these rules. We will notify you of the reason where reasonably possible.

4. Action-sport disclaimer & assumption of risk

Paragliding involves serious risk of injury or death. Conditions change rapidly; forecasts are estimates, not facts. By using OutDare you acknowledge and agree that:

  • You are solely responsible for assessing whether conditions are safe to fly, regardless of any verdict or alert OutDare displays.
  • You are solely responsible for being properly trained, licensed, insured, and equipped for the activity you intend to perform.
  • You are solely responsible for complying with all local laws, airspace restrictions, landowner rules, and club regulations at any spot you visit, whether or not such restrictions are reflected in OutDare.
  • Spot data, takeoff directions, weather, and flyability calculations are provided “as is” and may be incomplete, outdated, or wrong.
  • Push notifications may be delayed, fail to deliver, or fire incorrectly. Do not rely on OutDare alerts as a sole flight-planning tool.
  • You assume all risks associated with paragliding and any related travel, transport, and access to flying sites.

5. No warranties

OutDare is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, availability, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any defect will be corrected within a particular timeframe.

6. Limitation of liability

To the fullest extent permitted by applicable law, OutDare and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the service — including without limitation any injury, property damage, or death sustained while paragliding or travelling to or from a flying site. In jurisdictions that limit such exclusions, our total liability for any direct damages is limited to the amount you paid us for the service in the 12 months preceding the claim (which, for a free service, is zero).

Nothing in these terms excludes liability that cannot be excluded under applicable law (e.g. for gross negligence, wilful misconduct, or in respect of consumer rights that cannot be waived).

7. Indemnification

You agree to indemnify and hold OutDare harmless from any claim, loss, or expense (including reasonable legal fees) arising out of (a) your use of the service, (b) your violation of these terms, (c) content you submit, or (d) any flight, accident, or incident in which you are involved.

8. User-submitted content

When you submit a spot, takeoff direction, or other community content, you grant OutDare a non-exclusive, worldwide, royalty-free license to host, display, distribute, and modify that content within the service. You retain ownership. You represent that you have the right to share what you submit. We may remove submissions that violate these terms or that we reasonably believe are inaccurate or unsafe.

9. Third-party content

OutDare displays data from third parties (e.g. paraglidingearth.com for spot directories, Open-Meteo for weather, Mapbox for maps, embedded webcam streams). We do not control that content and are not responsible for its accuracy. Your use of webcam streams or external links is governed by the terms of those providers.

10. Account termination

You may delete your account at any time from in-app settings or by contacting contact@outdare.app. We may suspend or terminate accounts that violate these terms, infringe third-party rights, or are inactive for an extended period. On termination, the rights granted to you under these terms cease and we will delete your data per our Privacy Policy.

11. Changes

We may update these terms from time to time. Material changes will be announced in-app before they take effect. Continued use of OutDare after the effective date constitutes acceptance.

12. Governing law & disputes

These terms are governed by the laws of France, without regard to conflict-of-law principles. Disputes will be resolved by the competent courts of Paris, France, except where mandatory consumer-protection law in your country of residence grants you the right to bring claims locally.
